These Terms & Conditions (“Terms”) apply to your use of the Wave Wellness services provided via www.wavewellness.co.nz (“Website”) or content released by Wave Wellness and accessible via other platforms such as Instagram, Facebook and YouTube. If you do not agree, you must not use the services provided by Wave Wellness.

About Wave Wellness

 

Wave Wellness provides “Services” including, but not limited to – Fitness workouts, classes, programs, challenges, and related content. These are provided in the style of Power Vinyasa Yoga, Yin yoga, Mat Pilates, Reformer Pilates, meditations, journalling and mindful practices.

 

Eligibility

• You must be at least 18 years old, or have the consent of a parent/guardian if younger to use the services provided.

• For paid content - You must provide accurate account and payment information.

• You are responsible for maintaining the confidentiality of your login credentials.

Subscriptions & Billing

​

• The “Website” offers subscription access (monthly, annual, or other plans as specified).

• Subscriptions automatically renew at the end of each billing cycle unless cancelled by you, the user.

• Payment will be charged at confirmation of purchase.

• All payments are collected in $NZD (New Zealand Dollars).

• You are responsible for managing and cancelling your subscription through the Website.

• Prices may change; any price changes will be communicated to you in advance, and you will have the opportunity to cancel before renewal.

 

Free Trials

​

• If offered, free trials convert automatically to paid subscriptions unless cancelled before the end of the trial period.

• Each user is entitled to one free trial unless otherwise stated.

 

Refunds

​

• All payments are non-refundable, except as required by applicable consumer law.

• Refund requests must be made directly to Wave Wellness.

 

Usage Terms

​

• Wave Wellness content is for personal, non-commercial use only.

• You may not copy, reproduce, distribute, or exploit any content without prior written consent.

• You agree not to share your account with others.

• Your account is non-transferable.

• Your account may be suspended if there is any misuse.

 

General Video Content Disclaimer

These terms apply to all recorded content made available by Wave Wellness, including free content available to view on platforms – YouTube, Instagram and Facebook. The following 2 paragraphs are displayed within the description of each video uploaded to YouTube on the Wave Wellness Channel:
 

• By participating in these classes, you confirm that you do not suffer from any medical or mental health problems where physical exercise is contra-indicated by a Medical Professional. Please consult a Medical Professional before starting any new form of exercise, especially if you have any underlying health conditions. Your participation in any exercise shown is voluntarily, by performing these exercises, you do so at your own risk. You should always work to your own ability.
   

• You also accept full responsibility for any injuries you may sustain during, or as a result of, the classes. If you experience pain or discomfort at any time during this workout, you should stop immediately. You also accept that Wave Wellness is not liable or responsible for any injury / damage / loss incurred by participating in the classes. Please note that the classes on this channel have not been compiled with any consideration made for people who are pre/post natal, recovering from recent surgery, or suffering from any acute injuries and therefore may not be suitable.

 

Health Disclaimer

• Wave Wellness workouts are for general fitness purposes only.

• Always consult a medical professional before beginning a new exercise program, especially if you are pregnant, postnatal, injured, or managing a medical condition.

• You acknowledge that exercise carries risks and you voluntarily assume full responsibility for your participation.

• To the extent permitted by law, Wave Wellness is not liable for injuries, health issues, or damages arising from your use of the services provided.

• When engaging in private one-on-one sessions with Wave Wellness, you will be required to complete a consultation form and disclose any health conditions prior to any in person sessions.

Intellectual Property

• All content, videos, graphics, text, and trademarks on the Website are owned by Wave Wellness.

 

Third-Party Services

​

Wave Wellness may integrate with third-party platforms (e.g., Stripe, Zoom, analytics tools). Your use of these services may be subject to separate terms.

Termination

 

We reserve the right to suspend or terminate your account if you breach these Terms or misuse the services provides.

 

Service Interruptions

Our services may be suspended temporarily or permanently without notice. You acknowledge and agree that you are not entitled to a refund or rebate as a result of such service interruptions.

 

Limitation of Liability

 

To the fullest extent permitted by law, Wave Wellness is not liable for indirect, incidental, or consequential damages.

 

Governing Law

 

These Terms are governed by the laws of New Zealand. You agree to the exclusive jurisdiction of New Zealand courts.

 

Changes to Terms

 

We may update these Terms from time to time. Changes will be effective once posted on the Wave Wellness website. Continued use of the Wave Wellness services constitutes acceptance of the updated Terms.

 

Feedback

 

You may submit comments, suggestions or ideas about the Wave Wellness services, including ways in which we could improve our services, by email. You agree that your feedback is provided on a non-confidential basis, is voluntary, gratuitous, unsolicited and without restriction and Wave Wellness does not have any duty as a result of receiving your feedback.
